From August 26, new laws will affect small businesses

The right to disconnect and the ‘employee choice’ pathway for casual employees  already apply to non-small businesses, however from 26 August 2025 they will apply to small businesses as well.

Superannuation will be paid on Paid Parental Leave

From 1 July 2025, the government began paying superannuation on all government-funded Parental Leave Pay.


This change means that eligible parents with babies born, or adopted on or after, 1 July 2025, will receive the superannuation, based on the current Super Guarantee (SG) rate (12% from 1 July 2025 onwards).

   
   
   

Universities Under Scrutiny for Wage Theft

The Australian recently reported on an investigation by the Fair Work Ombudsman into 28 universities. The National Tertiary Education Union (NTEU) accused them of widespread wage theft, mismanagement, and a toxic internal culture, with over $218 million recovered on behalf of more than 110,000 employees.


Why it matters: This is a sharp reminder that compliance isn’t optional. Even large, reputable institutions can slip. Small businesses can afford to be proactive here and steer clear of reputational or legal pitfalls. High Court Expands Scope of ‘Genuine Redundancy’

The High Court’s recent decision  has broadened how the Fair Work Commission (FWC) can assess whether a redundancy is genuine. This significantly changes the scope of redeployment discussions during redundancy processes.


The ruling is expected to encourage unions and employees to push harder for redeployment during consultation. Employers will need clear evidence to prove that redeployment was not reasonably possible if challenged in an unfair dismissal claim.  Employers must take a wider view when exploring redeployment options.
