Empowering your workforce, driving your success

HR Insights July 2025

From the Director

As we step into the new financial year, it’s a timely reminder that what happens inside your business matters just as much as your BAS statement.

One of the most overlooked risks in many small businesses is how internal issues—misconduct, grievances, or inappropriate behaviour—are handled.

Or, too often, how they’re not handled. This month, we’re turning the spotlight on Workplace Investigations—what they are, when they’re needed, and why getting them right is not just about legal compliance, but about leadership, trust, and culture.

At Strategic HR, we conduct fair, confidential, and compliant investigations that protect your business while treating all parties with respect. And most importantly, we help you prevent things from escalating in the first place.

If you’re facing a difficult situation, or simply want to be better prepared, this month’s newsletter is for you. You’ll find practical insights, a featured article on the investigation process, and tips to help you stay ahead.

Because doing the right thing is always the smart thing. And when people feel safe, your workplace thrives.

7 Steps to a Fair Workplace Investigation

Handling workplace complaints can be tricky — especially if you’re worried about saying the wrong thing, taking the wrong step, or not knowing whether formal action is even needed. But the moment an issue is raised, your response matters. A poor approach can escalate tensions or expose your business to risk. A clear, fair, and timely process, on the other hand, protects your people and your reputation.

Here’s a simple breakdown of 7 key steps every fair workplace investigation should follow, whether you're dealing with bullying, misconduct, discrimination or a serious breach of policy.

  1. Receive the Complaint
Acknowledge the concern in writing and reassure the individual that it will be addressed in a timely and fair manner.
  2. Appoint an Investigator
Choose someone impartial with the right skills and training. If that’s not possible internally, outsource to a professional (like us).
  3. Plan the Investigation
Clarify the scope, decide what evidence is needed, and create a timeline. This avoids mission creep and keeps it focused.
  4. Gather Evidence
Collect documents, emails, logs or anything else relevant. Keep your process transparent and your records secure.
  5. Interview Relevant Parties
Speak to the complainant, the respondent, and witnesses. Ensure procedural fairness and allow all parties a chance to respond.
  6. Make Findings
Analyse all evidence. Were allegations substantiated or not? Document your reasoning clearly.
  7. Recommend Actions
Based on the findings, recommend appropriate next steps — from no action to disciplinary measures or further mediation.

Key Takeaway
Fair investigations aren’t just about “doing the right thing” — they’re also your best defence if a claim is made. Following a clear process demonstrates procedural fairness and can protect your business from legal and reputational fallout.

Not sure if an investigation is needed — or how to run one properly? We can help. Strategic HR offers discreet, compliant and fair investigations that protect everyone involved. Reach out for a confidential discussion.

Outlet operator faces court over migrant underpayment

On 10 July 2025, the Fair Work Ombudsman launched legal action against franchisee and manager of a United Petroleum outlet in western Melbourne.

They’re accused of issuing misleading pay slips, over‑stating wages, and underpaying an international student, reportedly paying as little as $14/hr instead of the lawful $28.38/hr. Penalties could exceed $13,000 per contravention.

Employers must ensure that the rates paid to employees do not fall below the new award rates or minimum wage.

Protect Your Business with a Fair Investigation Process

Not all complaints require a formal investigation — but when they do, it's critical to get it right. Our Workplace Investigations service is designed to give small businesses the confidence, clarity, and compliance needed.

At Strategic HR, we conduct fair, impartial investigations that:

  • Are fully compliant with Fair Work obligations
  • Minimise disruption to your business
  • Protect the rights of all parties involved
  • Deliver clear outcomes and actionable recommendations

We work with small businesses that don’t have internal HR support — and we also assist larger organisations where the internal HR team doesn’t have the capacity or objectivity to lead a full investigation. Our structured, external approach brings clarity, compliance, and peace of mind when it's needed most.

Why this matters

Mismanaging a workplace investigation can lead to legal risk, reputational harm, and further internal conflict. A clear, compliant process not only protects your business — it also builds trust with your team.

At Strategic HR, we don’t just conduct workplace investigations — we restore clarity, fairness, and trust when it matters most.
